26 GENERATIONS WINE CLUB
This section establishes the Terms and Conditions applicable to the 26 GENERATIONS WINE CLUB loyalty program.
By completing the membership application procedure for the 26 GENERATIONS WINE CLUB loyalty program, the Applicant acknowledges, understands and agrees to be legally bound by these Terms and Conditions.
1 – GENERAL INFORMATION
The company Marchesi Antinori S.p.A., whose legal headquarters are in Piazza degli Antinori, 3, Florence (Italy), is the creator and promoter of the loyalty program managed through the website www.26generazioni.com.
The Applicant confirms that the information provided is correct and complete and is responsible for maintaining the Applicant’s current contact information, updating it accordingly with any changes.
Only private individuals are eligible to enroll as members, who are of legal age as of the date of their first application, in accordance with all applicable laws.
Any commercial use of the 26 GENERATIONS WINE CLUB by applicants/members is strictly prohibited and will be considered a violation of these Terms and Conditions (for example, the purchase of products that are intended to be resold).
Marchesi Antinori S.p.A. has sole discretion to determine whether 26 GENERATIONS WINE CLUB is being used for commercial purposes.
Members are not permitted to use the 26 GERERATIONS WINE CLUB:
- In any way or manner that causes or could cause interruptions, damages, and disruptions to its services and operations;
- for fraudulent purposes or illegal activities;
- to cause disturbances, prejudice, or apprehension.
2 – REQUESTING MEMBERSHIP
The 26 GENERATIONS WINE CLUB will review membership applications and will advise applicants of the status of their request by email to the address provided on the application form.
Marchesi Antinori S.p.A. reserves the right to approve or reject membership applications.
Upon acceptance, the Applicant will receive an email, to the email address given on the application form, confirming membership and will provide login credentials (username) for their private account page. The member must create the password immediately after the initial login to the 26 GENERATIONS WINE CLUB.
Username and password must remain strictly confidential and personal and may not be transferred to third parties.
Each member will be held responsible for all activity on his/her account.
The username selected by the Applicant during the application process cannot be changed.
3 – RIGHT OF ADMISSION AND ACCESS TO THE PROGRAM
Marchesi Antinori S.p.A. reserves the right to suspend or terminate without notice membership in the 26 GENERATIONS WINE CLUB if the member doesn’t possess or has lost eligibility requirements and/or has breached these Terms and Conditions. Marchesi Antinori S.p.A. also reserves the right to cancel members’ status levels, achieved by accumulating points for purchases made, if the member does not comply with these Terms and Conditions.
Members may terminate their membership in the 26 GENERATIONS WINE CLUB at any time by written notice of termination to the email address: email@example.com
Upon membership termination, all accumulated points will be forfeited.
4-ACCESS TO THE 26 GENERATIONS WINE CLUB
Access to the 26 GENERATIONS WINE CLUB is permitted to members who have access credentials (username and password) for their private account page on our website.
Upon acceptance of the application, the Applicant becomes a member.
If no purchases are made within six months of account activation, login credentials and the member’s private account page will be deactivated and/or cancelled.
Members can purchase wines produced and distributed by Marchesi Antinori S.p.A. that will earn them points towards achieving member status. Status levels allow members to enjoy benefits and privileges available only to 26 GENERATIONS WINE CLUB members.
5 – COPYRIGHTS
26 GENERATIONS WINE CLUB is a registered trademark and property of the Marchesi Antinori S.p.A. company. All content published on or available from the 26 GENERATIONS WINE CLUB program including copy, graphics, logos, button icons, images, audio files, digital downloads, databases, and software are property of Marchesi Antinori S.p.A. and protected by Italian national laws, by international copyright legislation and rights on database protection.
It is strictly forbidden to copy and/or reuse in any way content from the 26 GENERATIONS WINE CLUB. In particular, it is not permitted to use data mining, robot or similar devices for data acquisition or extraction to extract (once or multiple times) any part of any service offered by the 26 GENERATIONS WINE CLUB. All graphic material, logos, page headings, button icons, font, brands and trademarks included in or available from the services offered by 26 GENERATIONS WINE CLUB are trademarks or distinctive features that are property of Marchesi Antinori S.p.A.
6 – MEMBER STATUS LEVELS
Members in the 26 GENERATIONS WINE CLUB earn 1 (one) point for each €1 (one euro) spent in purchases made through the website www.26generazioni.it.
For example, purchases totaling €1,89 earns the member 1 (one) point: purchases totaling €1,11 earns the member 1 (one) point.
Shipping costs do not qualify for points.
Points received by a member may not be redeemed for cash, exchanged or transferred to third parties.
Points received by a Member may not be sold, auctioned, bartered, brokered, purchased, or otherwise transferred.
If a member returns one or more products, points previously accrued for this/these items will be deducted from the member’s account.
All points expire on December 31st of the current program calendar year.
All points accrued during the program calendar year (January 1st through December 31st) must be redeemed no later than December 31st of that calendar year. Any points accrued that are not redeemed by December 31st of the calendar year in which they were accrued, will expire and cannot be redeemed.
The program has membership status levels. In order to qualify, members must accumulate a minimum of 600 (six hundred) points annually. The three membership status levels, reserved for members who accumulate 600 points annually, are: Bloom, Harvest and Vintage.
Once a member has reached a certain status level, that status level may be maintained for one year from the time the status level is achieved. At the end of this period of time, the member’s status level will be determined based on the points accumulated from January 1st to the date in which their yearly status level expires.
If the member has not accumulated enough points to maintain current status level or achieve a higher level during the period of time from January 1st to the date on which their annual status level expires, the member will be reverted back to the next-closest subordinate status level and will be assigned the minimum required points.
Members who have not accumulated the minimum required points for achieving status level Bloom will be returned to zero points.
For example for the program calendar year 2018:
– a member achieves Harvest status level on November 3rd, 2018;
– member’s points accrued from January 1st 2018 to November 2nd 2018 expire on December 31st, 2018;
– points accrued by the member from January 1st, 2019 and November 2nd, 2019 will determine the member’s status level for the following twelve months;
– if the member does not accumulate 1200 points during this period of time, the member will revert to Bloom status level and will maintain Bloom status until November 2nd, 2020 unless in the meantime the member accumulates enough points to re-qualify.
Members can login to their private account page on our website www.26generazioni.com to consult their current status level, the benefits associated with their status level and review points necessary to achieve the consecutive level.
Benefits associated with achievement of status levels are subject to change. Any changes made to these Terms and Conditions will become effective as of the date of posting on our website.
6.1 – STATUS LEVEL REQUIREMENTS AND BENEFITS
Points have no cash value. Points are only used to determine a Member’s qualification for different Membership Statuses (Bloom, Harvest, and Vintage), and as a means to determine the benefits that a Member may qualify for, if any.
There are three status levels in these Terms and Conditions: Bloom, Harvest and Vintage.
Bloom status is achieved when a member accumulates a minimum of 600 (six hundred) points to 1200 (one thousand two hundred) points.
Harvest status is achieved when a member accumulates a minimum of 1201 (one thousand two hundred and one) points to 1800 (one thousand eight hundred) points.
Vintage status is achieved when a member accumulates 1801 (one thousand eight hundred and one) points and above.
The benefits associated with each status level are detailed on the following chart and are subject to change.
The loyalty program is valid from July 1st, 2018 to December 31st, 2019. After this time, points accrued and benefits associated with the status levels will no longer be valid as per the regulations set forth in paragraph 6 of these Terms and Conditions, subject to Marchesi Antinori S.p.A.’s sole discretion to extend or change the program’s regulations.

7 – USE OF PERSONAL DATA
Marchesi Antinori S.p.A. is the data controller of all personal data acquired by our website.
Marchesi Antinori S.p.A. will handle personal data by adopting established security measures to prevent unauthorized access, disclosure, modification and/or destruction of personal data.
Personal data that is voluntarily provided directly by users is not collected in order to be associated with specific individuals but, by their own very nature, could enable identification through processing and association with data kept by third parties.
The user registered to the Wine Club will receive periodic informative and commercial newsletters from Marchesi Antinori S.p.A. The user will be able to unsubscribe from the newsletter service at any time by writing to firstname.lastname@example.org .
8 – LIMITATION OF LIABILITY
The user releases Marchesi Antinori S.p.A. and other associated entities and their respective employees from and against any and all claims for damages, losses, liabilities and any other expenses ensuing from or relating to the incorrect use of the loyalty program i. e. non compliance with the provisions of the law and/or of these Terms and Conditions.
Marchesi Antinori S.p.A. will not be held responsible for any disservices due to failures or malfunctions in devices used to connect, network connections, hardware, software, Internet, Internet Service Providers or for problems arising from data congestion or for any unauthorized human interventions.
9 – CHANGES TO THE PROGRAM
Marchesi Antinori S.p.A. reserves the right to adjust the number of points required to achieve status levels in the program, the right to change the benefits associated with each level, to modify the validity period for status levels and to change the guidelines for converting amount spent into points without prejudice to the rights acquired in the meantime.
Any cancellations, suspensions and / or changes to the 26 GENERATIONS WINE CLUB will go into effect immediately upon posting to our website, unless otherwise specified.
10 – USE OF SOFTWARE
The use of our software is permitted exclusively for accessing the services offered by 26 GENERATIONS WINE CLUB pursuant to these Terms and Conditions and to the general terms of sale (link general terms of sale).
It is strictly prohibited to: a) incorporate any part of our software into user programs; b) transfer our software for use in connection with another service, or sell, rent, lease, distribute, sublicense, or transfer any or all of the software rights; c) use the software for illicit purposes; d) copy, modify, perform “reverse engineering”, decompile or disassemble or otherwise interfere with the software in whole or in part or create derivative works of the software.
In order to keep the software up-to-date, Marchesi Antinori S.p.A. can provide automatic or manual updates at any time, without notice.
11 – APPLICABLE LAW AND JURISDICTION
